Terms of Use

These Terms of Use ("Terms") govern your access to and use of Apex Proficiency (the "Service"), operated by Igor Gasperoni Stori (CNPJ 59.667.880/0001-05) ("we," "us," or "the operator"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service is

Apex Proficiency is an independent, subscription-free practice platform for the CELPIP-General test. We provide simulated practice sections (Listening, Reading, Writing, and Speaking), an estimated level per skill, and feedback on Writing and Speaking responses generated by an AI system and confirmed by human correctors.

Apex Proficiency is not affiliated with, endorsed by, or produced by CELPIP or Paragon Testing Enterprises. "CELPIP" is a registered trademark of its respective owner, used here only to describe the exam our practice materials prepare you for. Your estimated level is a study aid, not an official score, and only the real CELPIP test administered by the official provider can produce an official result.

We may add, change, reorganize, or discontinue practice content and features of the Service over time to keep it accurate and useful. We will not remove access you have already paid for during your active plan.

2. Eligibility and accounts

You must be at least 16 years old to create an account. If you are between 16 and the age of legal majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Let us know immediately at support@apexproficiency.com if you suspect unauthorized use of your account.

3. Plans, payment, and access

Each plan (Starter, Full Prep, or Exam Ready) is a single, one-time payment that grants access to the Service for a fixed number of days from the date of purchase, as described on the pricing page at the time you buy. Plans are not subscriptions: there is no auto-renewal and no recurring charge. When your access period ends, you can purchase a new plan to continue.

Payments are processed by Stripe, a third-party payment processor. We do not store your full card details. Prices are listed in US dollars and may change for future purchases; changes do not affect a plan you already bought.

4. Your right to cancel and get a refund

If you are a consumer purchasing from Brazil, Brazilian law (Article 49 of the Consumer Protection Code, Law No. 8,078/1990) gives you the right to withdraw from a purchase made online within 7 (seven) calendar days of the purchase date, for any reason and without having to justify it, with a full refund. To use this right, email support@apexproficiency.com within that window with your account email and purchase date.

Outside of this legal right, refunds are considered case by case; contact support@apexproficiency.com and we will do our best to help.

5. Acceptable use

You agree not to:

  • Share your account or resell access to the Service;
  • Copy, scrape, redistribute, or publish practice questions, audio, or other Service content outside the platform;
  • Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its underlying systems;
  • Submit content that is unlawful, abusive, or infringes someone else's rights as a Writing or Speaking response; or
  • Use the Service for any purpose other than your own CELPIP preparation.

We may suspend or terminate accounts that violate these rules.

6. AI-assisted and human-reviewed feedback

Writing and Speaking responses you submit are first read by an AI system to produce an estimated score and written feedback, and then reviewed and confirmed by a human corrector before the feedback is released to you. Estimated levels are a good-faith, well-calibrated approximation based on our understanding of the CELPIP rubric; they are not a guarantee of the score you will receive on the official exam, and we make no promises about your exam outcome.

7. Your content

You retain ownership of the essays, recordings, and other responses you submit ("your content"). By submitting your content, you grant us a license to store, process, and use it (including sending it to the third-party AI provider described in our Privacy Policy, and to human correctors) solely to provide you with scoring and feedback, to operate and improve the Service, and to comply with the law.

8. Intellectual property

All practice questions, audio, visual design, software, and other materials that make up the Service (excluding your content) belong to us or our licensors and are protected by copyright and other laws. You may use them only for your own personal exam preparation.

9. Disclaimers and limitation of liability

The Service is provided "as is," without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free, or that using it will result in any particular CELPIP score or immigration, citizenship, or academic outcome. To the maximum extent permitted by law, our total liability arising from your use of the Service is limited to the amount you paid for the plan giving rise to the claim.

10. Third-party services

The Service relies on third-party providers to operate, including Supabase (database and authentication), Vercel (hosting), Stripe (payments), Anthropic (AI-generated feedback), and Google Analytics (usage analytics). Their own terms and privacy practices apply to the parts of the Service they provide.

11. Termination

You may stop using the Service and ask us to delete your account at any time by emailing support@apexproficiency.com. We may suspend or terminate your access if you violate these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Brazil. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Brazil, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence.
